While such events are rarely publicised, extortion against corporate assets or products is increasing rapidly on a global scale with a recent emphasis in North America.

Medical Malpractice

Clinical negligence insurance costs, have over the past decade, steadily risen as the MDU, MPS and MDDUS (the mutual organisations) have been hit with the higher frequency and severity of third party claims.

This has been fuelled by the growth and popularity of litigation entities many of whom work on a contingency fee basis.  As a result, the mutuals have been forced to pass these costs on to all their members, irrespective of their individual track records.

Chesterfield have developed a unique product that is specifically aimed at NHS- based surgeons who undertake work within the Private sector.

The NHS is a unique institution which provides both the training ground and hospital base for Surgeons to qualify, practice and develop their skills within their individual surgical disciplines. As each Consultant has to provide their individual operating statistics, annually, our product recognises and rewards those surgeons whose results illustrate ‘best practice’.

Our policy does not just rely on a completed proposal form but uniquely has a built in “Risk Managed Acceptance” approach. On joining, we request from each applicant one or two working examples of patient notes, starting from consultation to patient discharge. These are then assessed by our risk managers. This group comprise currently certified, GMC registered,  surgeons and GP’s who,  from these notes,  can assess the areas of exposure.  We then address these issues to ensure our client’s future practice methods become more robust from the threat of any possible future litigation.

The claims management team is run by the former head of a Medical Defence Organisation claims department. This expert takes a stance on early intervention, thereby bringing claims to an early conclusion reducing costs and protecting reputations.

Property, Energy and Construction Liability

With a growing emphasis on renewable and “green” sources of energy, the insurance market is beginning to respond to customers’ demands for bespoke solutions.

Climate change, increased seismic activity and the associated potential catastrophe risks to property assets could be devastating to your business. Risks associated with large construction and engineering projects – particularly energy and infrastructure related, in increasingly complex technical and regulatory environments, are growing almost exponentially.

Legal Liability exposures are in a constant state of flux becoming ever more onerous to business communities throughout the world. These pose threats to both your financial and reputational risk.

Residual Value Insurance

At Chesterfield, our specialists work with a wide range of clients to ensure that their Residual Value Insurance protects an agreed future value of an asset where the financing instrument does not fully pay-out at the expiry of the period.

Every enquiry is handled on an individual ‘case by case’ basis to ensure that future asset values are properly agreed between our client and the underwriter.

Wordings are carefully crafted, with a view to preparing for the clearest outcome in terms of asset valuation at the policy term, to meet the expectations of all parties.

Examples of this are:

  • Aircraft
  • Marine
  • Rail and intermodal
  • Power generation
  • General commercial ad industrial equipment

In addition to the above asset classes, if the asset has a liquid secondary market with low obsolescence, together with accessible market data, we will give consideration to extending cover.

The potential future value of the asset often becomes a balloon payment on the part of the lessee – borrower, which can be insured.

In some jurisdictions, the insurance can be used by lessors for accounting purposes to obtain enhanced income recognition from leases and by manufacturers to recognise the profit in a sales transaction with a buy-back.

The policy has an S&P A rating and typical periods of cover run from 3 – 12 years depending on the asset class with few restrictions of jurisdiction.
